Terms of Use

These Terms of Use ("Terms") govern the use of the website hosting, professional email, domain and database services offered by SERVICETECH LTDA, CNPJ 57.845.942/0001-98 ("LMSHost", "we"), available through the website and control panel.

By creating an account or using any of our services, you state that you have read, understood and fully agree with these Terms and with our Privacy Policy.

1. Description of services

LMSHost offers, in a contractable and configurable way according to the customer's needs:

• Website and web application hosting
• Professional email accounts, aliases and forwarding
• Domain registration and/or pointing
• Databases

The space, sending limits and other characteristics of each service are as described in the plan chosen at the time of signup, and may vary according to catalog updates.

2. Registration and account

• You are responsible for providing true, complete and up-to-date information when registering.
• You are responsible for keeping your password confidential and for all activities carried out through your account.
• You must notify us immediately of any unauthorized use of your account.

3. Acceptable use

By using LMSHost's services, you agree not to:

• Send spam, unsolicited bulk email or fraudulent (phishing) content
• Host or distribute malware, viruses or any malicious code
• Host illegal content, or content that violates third-party intellectual property rights
• Use the services to carry out attacks on third parties (e.g., DDoS, unauthorized network scans)
• Use resources in a way that compromises the stability of the shared infrastructure or of other customers

Failure to comply with this section may result in immediate suspension or cancellation of the account, without prior notice, depending on the severity of the violation.

4. Domains

Domain registration and/or pointing is subject to the policies of the respective registry and registrar. It is the domain holder's responsibility to keep the domain's registration data correct and up to date. LMSHost is not responsible for domain ownership disputes between third parties.

5. Payment, trial and cancellation

• Plans are billed according to the frequency chosen (monthly or yearly) at the time of signup.
• Payment is processed by Stripe for customers outside Brazil and by Mercado Pago for customers in Brazil, depending on your location.
• When offered, the free trial period does not require a credit card and can be cancelled at any time before billing.
• Non-payment by the due dates may result in temporary suspension of services until the matter is resolved.
• Cancellation can be requested at any time through the control panel or support channels.

6. Service availability

We make commercially reasonable efforts to keep the services continuously available. Scheduled maintenance, when necessary, will be communicated in advance whenever possible. LMSHost does not guarantee uninterrupted availability and is not responsible for outages caused by factors beyond its reasonable control (e.g., third-party connectivity failures, force majeure events).

7. Backups and data responsibility

We maintain backup routines as an additional security measure, but this does not replace the customer's responsibility to keep their own up-to-date copies of all content, emails and settings critical to their business.

8. Intellectual property

All content uploaded, hosted or transmitted by you through our services is your sole responsibility and property. The LMSHost brand, control panel and platform are the property of the company and may not be copied, reproduced or used without authorization.

9. Limitation of liability

To the maximum extent permitted by applicable law, LMSHost will not be liable for indirect damages, lost profits or data loss arising from the use or inability to use the services, except in proven cases of willful misconduct or gross negligence.

10. Suspension and termination

We may suspend or cancel your account in the event of a breach of these Terms, unresolved non-payment, or use that endangers the security of the platform or other users. You may close your account at any time, without prejudice to amounts already owed up to the cancellation date.

11. Changes to these Terms

We may update these Terms periodically. Material changes will be communicated by email or a notice in the panel, with the new effective date shown at the top of this document. Continued use of the services after the update implies acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Porto Alegre/RS are hereby elected to settle any disputes arising from these Terms, regardless of the customer's location, with express waiver of any other, however privileged it may be.
